Terms & Conditions For Real Estate Photography Services
Bronte Lockwood Photography is a photography service owned and operated by Bronte Lockwood Photography (the “Photographer”). Please read these terms & conditions carefully before making any bookings with us as they constitute a legally binding agreement between the person booking our services (the “Client”) and the Photographer.

Booking Confirmation
All bookings will be confirmed by the Photographer prior to the appointment. If access depends on an agents attendance, and the agent is running late a 15 minute grace period is held. After this time a fee may be charged and the Photographer reserves the right to leave the address.

If the booking was not made through an online booking system, the booking will only be confirmed once the Photographer has all the relevant information to attend the booking. This includes the preferred time, the address, the access information and the type of products/services required from the photographer. 

Delivery
Delivery is 1-2 days unless requested sooner, in which a fee may apply. Next day delivery applies to business days only. 

Fees and Charges
Any additional fees will be advised prior to undertaking any services.
Franchisees of Bronte Lockwood Photography are independent proprietors; GST may not be collected and will be outlined appropriately on the invoice. Where GST is required, it will be outlined prior to your booking and/or on the price list supplied.

Client Responsibilities
It is the Client’s responsibility to advise their Clients (Vendor, Tenants, Landlord) of appropriate appointment times.
If a property is unattended at arrival where access is not possible, a cancellation fee of 50% of the total booking value will be charged.

Travel Charges
Properties outside a 50km radius of a local Bronte Lockwood Photography franchisee may incur additional travel charges of up to $0.40 per kilometer. This will be outlined prior to undertaking any services.

Delivery of Works
All works will be supplied to the Client electronically via email.
In some situations, works may be supplied in low-resolution with a watermark until full payment is made, upon which high-resolution images will be released.

Payment Terms
The Photographer will invoice for services within 14 days of completion unless otherwise advised. Payments are due within 30 days of the day it is created. Payment must be made in accordance with the terms set out on the invoice. No License Usage Agreement is granted until full payment has been received.

Inspection and Defects
The Client agrees to inspect all delivered works and notify the Photographer of any defects within 5 working days. Failure to do so will result in no liability for any defects, and a fee will be applicable for any editing after this time.

Health and Safety Compliance
The Photographer must abide by all workplace health and safety rules, practices, laws, and general respect for the property and people. The Photographer’s liability is limited to professional fees paid prior to the photo shoot. The Client warrants that any permissions or legal rights for access to the property have been obtained.

Liability and Indemnity
The Photographer accepts no liability resulting from photographing a property. The Client agrees to indemnify, defend, and hold harmless the Photographer from all claims, damages, expenses, and liability arising out of or connected with photographing the property.

Copyright and Usage Rights
Copyright of all photographs, videos, floor plans, or graphics created by the Photographer remain with the Photographer.
The Photographer has the right to use and display any photographs, videos, floor plans, or graphics for promotional purposes.
The Client warrants that all individuals appearing in the photographs have consented to be photographed and their images used as described.

License Usage Agreement
In the absence of a custom License Agreement, the standard non-exclusive, individual License Usage Agreement grants the Client a limited usage right to reproduce, publicly display, and distribute the Photographs only for promotional purposes related to the listing of the Property. The License expires when the listing purpose is achieved.
This License is non-transferable and any breach will result in immediate termination.

Governing Law and Jurisdiction
This Agreement is governed by and construed in accordance with the laws of New South Wales. The parties submit to the exclusive jurisdiction of the Courts of New South Wales.

Severability
If any provision is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected.

Satisfaction Guarantee
All packages come with a 100% satisfaction guarantee.
